法律与标准关系视域下修订《职业教育法》的若干思考 被引量:8

摘要 法律和标准是职业教育稳步发展的保障。法律为职业教育实践设定基本框架和底线要求,是职业教育全过程的制度保障;标准为职业教育活动提供具体规则和规范引领,是职业教育各环节的质量规范。依据法律与标准的互动协同关系,结合我国职业教育法治化和标准化的现状,借鉴其他国家的相关经验,得出结论:只有坚持标准必须入法、教育质量评价标准是重点、教师能力标准是关键、教育标准与职业标准依法衔接、依法监督和评估教育标准五项原则,才能提高我国《职业教育法》的立法质量,切实增强法律和标准在职业教育发展中的合力。 Laws and standards are the guarantee for the steady development of vocational education.The law sets the basic framework and bottom-line requirements for the practice of vocational education,and is the system guarantee for the whole process of vocational education;standards provide specific rules and norms for vocational education activities,and are the quality standards for all links of vocational education.Based on the interactive and synergistic relationship between laws and standards,combined with the status quo of the rule of law and standardization of vocational education in China,and learning from the relevant experience of other countries,it is concluded that only by adhering the five principles including standards must be included in the law,education quality evaluation standards are the focus,teacher competence standards are the key,education standards and professional standards are connected in accordance with the law,and supervision and evaluation of education standards in accordance with the law,which can improve the legislative quality of China’s Vocational Education Law and effectively strengthen the joint force of laws and standards in the development of vocational education.
