摘要
当今社会处于智能时代逐渐来临的时期,人工智能是智能时代的代表性产物。人工智能的迅猛发展对各个产业都带来了挑战与变革,其中就包括了知识产权领域。随着人工智能的不断发展升级,根据人工智能的特性,人工智能可以在短时间内创造大量可以媲美人类的作品,这些作品又具有一定的经济价值。如果没有一定的法规对其进行定性规范,必定会引起市场混乱与著作权纠纷,在权利归属不明的情况下,可能会导致公地悲剧或反公地悲剧,从而使人工智能的创作物无法很好地为人类所用。为人工智能生成内容提供法律保护是增进社会财富、防止公地悲剧与反公地悲剧的发生、促进人工智能技术提升和产业发展的必然要求,笔者认为要对人工智能的主体资格、人工智能创作物的属性和人工智能创作物的著作权归属等做出研究,制定出相应的规定来对人工智能创作物进行保护。
Today’s society is in the era of intelligence, and artificial intelligence is a representative prod-uct of the intelligent era. The rapid development of artificial intelligence has brought challenges and changes to various industries, including the field of intellectual property. With the continuous development and upgrading of artificial intelligence, according to the characteristics of artificial in-telligence, artificial intelligence can create a large number of works comparable to human works in a short period of time, and these works have a certain economic value. If there are no certain regu-lations to qualitatively regulate them, it will certainly lead to market confusion and copyright dis-putes, which may lead to tragedy of the commons or anti-tragedy of the commons in the case of un-clear ownership of rights, thus making the creations of AI not well available for human use. Provid-ing legal protection for AI-generated contents is an inevitable requirement to promote social wealth, prevent the occurrence of tragedy of the commons and anti-tragedy of the commons, and promote the improvement of AI technology and industrial development. I believe that we should study the qualification of AI subjects, the attributes of AI creations and the attribution of copyright of AI creations, etc., and formulate corresponding regulations to protect AI creations.
