市场支配地位的认定是规制市场主体滥用市场支配地位的前提条件。大数据企业具有网络外部效应、用户锁定效应以及兼容性和标准化等特点,其市场支配地位的认定与传统行业具有较大区别。在大数据市场支配地位的认定中,应当结合大数据企业的特殊性扩大市场壁垒认定标准、改进市场份额的推定方法、强化对交易相对人依赖性因素的考察。
The recognition of market dominance is a prerequisite for regulating the dominant position of market dominance. Big data companies have such characteristics as network external effect, user locking effect and compatibility and standardization so that the recognition of market dominance is consistent with that of traditional industry. The identification of big data market dominance should be combined with the particularity of big data enterprises to recognize market barriers, improve market shares and to strengthen the relative dependence of the transaction factors.
