摘要
网络环境下滥用市场支配地位行为的认定有其特殊性。判定一个经营主体是否有滥用市场支配地位行为,应当在正确界定"相关市场"的前提下,判断该经营者在该"相关市场"内是否具有"市场支配地位",并分析其是否有"滥用"该"市场支配地位"的行为。而在网络环境下,需增加考虑网络特性,如外部性、开放性、虚拟性、无界性等对相关市场界定的影响;同时,基于网络环境下技术创新迅速、用户与经营者进出都相对容易等特点,在市场支配地位的认定中需要全面统计、动态观察;另外,在网络环境下,一些看似反竞争的行为如果具有"效率"正当性理由并且不严重限制竞争的,应运用"合理原则"不予以反垄断法规制。
There exists its specialty in identifying a business entity's behavior of abusing its dominant market position under the internet environment.First,its ' relevant market' should be correctly defined,and then the business entity's behavior of whether it conducts the dominant market position can be decided with the analysis of whether it has the behavior of abusing the 'dominant market position'.However,in the case of internet,some specialties of the internet environment are to be considered,such as its extensiveness,openness,virtuality and boundlessness,which have big impact on how to define the 'relevant market'.Meanwhile,that technology innovations emerge almost in every minute and that users and business dealers can enter and leave the internet market relatively easily make it necessary to have comprehensive statistics and results based on the dynamic observation in identifying its dominant market position.furthermore,some seemingly anti-competitive business conducts may be justified as being efficient or benefiting the consumers and aligning with the interests of the public.In such cases,the antitrust law may not be applied based on jurisdictional rules of reason.
