摘要
《宪法》和《监察法》虽为监察委员会依法行使监察权奠定了法律基础,但如果监察法律体系转型不及时也有可能制约国家监察权依法行使。无论是基于路径依赖的理论,还是基于领域法学概念的兴起,抑或是出于填补《监察法》的立法漏洞或空白,从而确保监察权在法治轨道上有序运行,监察立法都应当尽快体系化。制定新法与修改已有法律作为实现监察立法体系化的两种重要方式,应受到同等重视。新法的制定除需全国人大常委会加大监察法律制度供给外,还需全国人大尽快启动《立法法》修改进程,分别赋予国家监察委员会和省级监察委员会以监察法规和监察规章制定权。新法的制定与旧法的修改将助推以《宪法》和《监察法》为基础,监察特别法为骨干,监察法规、监察规章为配套规范的监察立法体系的最终形成。
Although the Constitution and the Supervision Law have laid a legal foundation for the supervision committee to exercise its power of supervision according to law,the collapse of the supervision law system in the era of administrative supervision has also restricted the state’s supervision power from exercising according to law. Whether it is based on the theory of path dependence,or based on the rise of the concept of the field of law,or fill out the legislative loopholes of Supervision Law to ensure that the orderly operation of the supervision power in the rule of law,legislation should be systematic as soon as possible. New legislation and amend existing laws as two ways to achieve legislative system of supervision should be given equal attention. Besides,the law supply in addition to the National People’s Congress( NPC),mainly depends on the legislative law to adjust as soon as possible,by which national and the provincial supervisory committee can be given necessary legislative power. Only in this way,can the supervision legislation system be formed,in which the constitution law and supervision law takes the role of foundation,supervisory special law the backbone,supervisory regulations and rules the main body.
