摘要
在新的时代背景下,国家新设监察委员会,其与当地纪委合署办公,实行一套工作机构、两个机关名称的工作方案。纪委监委精诚合作,共同行使纪律检查及国家监察职能,构建起全方位权威、严密且高效的反腐体系。在"两委"合署办公体制下,由于执法与执纪在执法对象、办案流程等方面具有一致性,故党纪与国法要有效衔接;然而,源于党纪与国法在内涵、外延等各方面殊有不同,两者须予区分,执纪与执法绝不能简单取代,合署并不等于合并。要正确处理党纪与国家法律间的关系,既要实现纪法衔接,又要坚持纪法分开。依规治党和依法治国的有机统一,必将助力中华民族伟大复兴中国梦的更好实现。
In the new era,the State has set up the Supervisory Committees to work with local Commissions for Discipline Inspection through one shared institutional framework with two different names.These two agencies are expected to jointly exercise the functions of discipline inspection and state supervision to establish a rigorous and efficient anti-corruption system.Under the Co-working system,the enforcements of discipline and law are common in terms of enforcement targets and procedures,which enables party discipline to be coherent with law of the State.However,they are different regarding the connotation,scope,and so forth.Hence,the enforcements of discipline and law should not be mutually replaced.This article suggests handling the relationship of party discipline and law of the State correctly.The integration of"governing the Party by rules"and "ruling the country by law"will help to fulfil the Chinese dream of national rejuvenation.
