摘要
处理劳动争议案件的首要问题是判断争议双方主体是民法上的劳务关系还是劳动法上的劳动关系。由于我国立法中未对劳动关系的本质作出明确规定,因此,司法实践中常出现判断困难。本文结合案例,从雇佣历史发展的角度,对劳动关系的本质属性进行了分析,并论述了劳务关系和劳动关系区分的基本要点。
The first step in settling employment disputes is to identify the nature of the service. In the legal practice, this is often diffi cult due to the reason that there are no rules in the legislation in China. This essay, based on the historical development of employment and combined with a case, analyzes the nature of contract of service and the standards in distinguishing the difference.
