新职教法省域实施效果评估:理论基础与框架体系

摘要 评估反馈新职教法省域实施效果,对促进新职教法立法质量的提高和立法目的实现非常必要。从法律实施效果评估与立法后评估这两个概念的关系入手,界定新职教法省域实施效果评估的内涵。有限理性等理论是新职教法省域实施效果评估的人性论基础,立法过程理论、法律实效理论是法理学基础,政策科学是方法论基础。在分析目前三种类型评估主体优缺点的基础上,构建国家机关和第三方机构组织实施、利益相关者广泛参与的多元评估主体;在分析评估标准的基础上,构建以实施效果为重点的复合型评估指标体系;从调查方法、分析方法这两个维度,构建评估方法体系。 Evaluating feedback on the provincial implementation effects of the new Vocational Education Law is essential for improving the quality of legislation and achieving its intended goals.This study begins by exploring the relationship between the concepts of legal implementation effect evaluation and post-legislative evaluation,thereby defining the connotation of provincial implementation effect evaluation for the new Vocational Education Law.The theoretical foundations for this evaluation include limited rationality theories(as the anthropological basis),legislative process theory and legal effectiveness theory(as jurisprudential foundations),and policy sciences(as the methodological basis).On the basis of analyzing the advantages and disadvantages of three types of evaluation bodies,the study proposes a pluralistic evaluation model involving both governmental agencies and third-party organizations,with extensive participation from stakeholders.Regarding evaluation standards,a composite evaluation index system focusing on implementation effects is constructed.Furthermore,evaluation methods are systematized by integrating survey and analytical approaches within two dimensions.
