摘要
学界通说认为我国宪法规范因具有原则性、抽象性等特征而不适宜直接适用。我国宪法规范部分条款的含义固然不够明确,但《宪法》正文的宪法规范有超过二分之一的条款内容含义较为明确,具备可直接适用的条件。最高人民法院发布的《人民法院民事裁判文书制作规范》规定“裁判文书不得引用宪法”,但又规定“(宪法)体现的原则和精神可以在说理部分予以阐述”。由此,宪法援引可以分为“适用性援引”和“遵守性援引”,现阶段优先执行“遵守性援引”,待条件成熟后再逐步推进“适用性援引”,以此实现宪法规范直接适用的渐近式发展。
The prevailing view in the academic circle holds that the constitutional norms of China are not suitable for direct application due to their characteristics such as principle and abstraction.Indeed,the meanings of some clauses of China's constitution norm are not clear enough,but more than half of the clauses in the main body of the constitution norm are clear and have the conditions for direct application.The Supreme People's Court's Standards for the Production of Civil Judgment Documents stipulates that"the constitution shall not be cited in judgment documents",but also stipulates that"the principles and spirit embodied in(the constitution)may be expounded in the rational part"'.Therefore,the constitution invocation can be divided into'applicable invocation"and"compliant invocation".At present,the"compliant invocation"is given priority,and after the conditions are ripe,the"applicable invocation"is gradually promoted,so as to realize the asymptotic development of the direct application of constitutional norms.
