摘要
婚娶彩礼为从古沿袭至今之公序,不仅是对“尚礼”的民俗心理的契合,也是对婚姻认可的程序性表达。婚娶彩礼在我国经历了传承、变迁、异化与外化的过程。近年来彩礼持续飞涨,不仅混淆道德判断标准,引发家庭矛盾,还诱发违法犯罪,影响社会稳定。在乡村振兴战略背景下,多元治理主体应着眼于从社会管理转向社会治理的变革,建立多层次、全方位的创新治理机制,从文化引导、政策规制、司法介入、孝道养成、经济激励等多方面协同发力,有效抑制婚娶高额彩礼的高额化趋势。
The practice of giving betrothal gifts has been a longstanding and established social custom,not only echoing the folk psychology of"valuing gifts"but also serving as a procedural expression of marital recognition.In China,this tradition has undergone a process of inheritance,transformation,alienation,and externalization.In recent years,the escalating cost of betrothal gifts has not only blurred moral judgment standards,but also affected family harmony,induced illegal activities,and undermined social stability.In the context of the rural revitalization strategy,multiple governance entities should focus on transitioning from social management to social governance.They should establish a multi-level and comprehensive innovative governance mechanism,collaborating from various aspects such as cultural guidance,policy regulation,judicial intervention,filial piety cultivation,and economic incentives,to effectively curb the trend of escalating high betrothal gifts.
