职务违法犯罪治理的权力图谱:功能配置与行权逻辑

摘要权力配置及其互动是职务违法犯罪治理中的核心命题,互相配合与互相制约是相关权力互动的主要模式。如果法律规范侧重强调互相配合,对互相制约着墨较少,权力互动就难以达到制度的预设效果。在确保监察权权威、高效行使的同时,需要优化相关权力的行权规则,形成良好的互动关系。借助功能适当原则的分析框架,职务违法犯罪治理中的权力关系应当体现民主集中制的要求,实现权力正确且有效行使,以及形塑配合与制约并行的制度样态。应以制度化实现相关权力的功能分层,塑造程序衔接机制以实现权力间的功能互补,以及建立嵌入式的立体权力制约动态平衡机制,最终实现反腐败效能与程序正义的价值统合。 The allocation and interplay of powers constitute the core propositions in the governance of duty-related violations and crimes,with mutual coordination and restriction the primary modes of power interaction.Provided that greater emphasize is put on mutual coordination than restriction by legal norms,the interplay of powers would scarcely achieve the statutorily prescribed outcomes.To ensure the authoritative and efficient exercise of supervisory power,it is imperative to refine the governing rules for power execution and foster constructive interagency dynamics.Using the analytical framework of the principle of functional appropriateness,the power relations in the governance of duty-related violations and crimes should reflect the requirements of democratic centralism under the leadership of the Party,achieve the correct and effective exercise of power,and form an institutional structure where coordination and restraint function in parallel.Through the principle of functional appropriateness governing,the power relations in the governance of duty-related violations and crimes must:embody democratic centralism under the leadership of the Party,ensure the legitimate and effective exercise of authority,and form an institutional structure where coordination and restraint function in parallel.It is necessary to realize the functional stratification of relevant powers through institutionalization,shape a procedure connection mechanism to achieve functional complementarity among powers,and establish an embedded three-dimensional dynamic balance mechanism for power restriction,ultimately unifying the value integration of anti-corruption efficacy and procedural justice.
