摘要
法治是粤港澳大湾区建设的应有之义和必然要求。本文从大湾区建设立法保障的角度梳理当前大湾区建设的制度和立法保障情况,指出当前粤港澳大湾区建设立法保障工作亟待解决的问题有:内地与港澳经济融合发展的法律定位不清,粤港澳三地存在重大法律制度差异,国家层面的修法有待进一步支持大湾区建设工作,地方推动相关立法面临权限困境,立法需求和立法路径有待明确。建议通过完善大湾区立法保障工作机制、统筹处理好立法与改革的关系、加快国家层面的修法调法、争取国家放权赋能、发挥地方立法合力、完善协同立法机制等措施加强粤港澳大湾区建设立法保障工作。
The rule of law is very important for the construction of the Greater Bay Area of Guangdong,Hong Kong region and Macao region.This paper explores the current system and legislative protection for the construction of the Greater Bay Area,and points out that the current legislative protection for the construction of the Greater Bay Area is faced with the following issues:(1)the legal positioning of the economic integration and development with the Mainland is unclear,(2)the major legal systems of Guangdong,Hong Kong region,and Macao region differ from one another,(3)the coordination mechanism of the legislative amendment work at the national level should be improved,(4)the local authorities are faced with the difficulties in passing the relevant legislation,and(5)the legislative demands and paths need to be clarified.It is suggested that the legislative protection work be strengthened for the construction of the Greater Bay Area by improving the working mechanism of legislative support for the Greater Bay Area,dealing with the relationship between legislation and reform in an integrated manner,accelerating the amendment and adjustment of laws at the national level,striving for the national decentralization of power and empowerment,giving full potential to the joint efforts of the local legislatures,and improving the mechanism of coordinated legislation,and other measures.
