摘要 “一国两制”下中央对香港特区高度自治权的运行享有全面监督权,这种全面监督权以中央与香港特区之间的授权与被授权关系为政治基础,以宪法与香港基本法规定的授权框架为法制基础,旨在实现“一国两制”方针的根本宗旨:维护国家主权、安全、发展利益,保持香港长期繁荣稳定。中央全面监督权可以从越权性监督、程度性监督和不足性监督三个层面来理解,通过硬性与软性两种方式来行使。由于香港地区社会存在对“一国两制”下香港特区宪制秩序的“体制性不认同”,所以,中央需要更加注重使用软性监督方式,即通过国务院港澳办、香港中联办的发言人等机制,及时对香港社会出现的一些特定言论、行为以及一些新情况,提出批评、意见或者建议,阐释清楚中央对“一国两制”下香港特区宪制秩序的理解,从而逐渐消除香港社会的“体制性不认同”,为“一国两制”在香港特区的全面准确贯彻落实奠定坚实的认同基础。 The central government exercises overall supervision over the high-degree autonomy of Hong Kong S.A.R.under the principle of“one country,two systems”,with their relationship of authorization as political basis and the authorization structure stipulated by China’s Constitution and the Basic Law of Hong Kong as legal basis,by following the principle of“one country,two systems”as the fundamental purpose to safeguard China’s sovereignty,security,and development interests and maintain long-term prosperity and stability in Hong Kong.The overall supervision of central government can be understood from three levels(high-authority,procedure,and insufficiency supervision)and exercised by hard and soft ways.Because Hong Kong region society don’t have“institutional identification”of the constitutional order of Hong Kong S.A.R.under the principle of“one country,two systems”,the central government should emphasize more on soft supervision by Hong Kong and Macao Affairs Office of the State Council and Liaison Office of the Central People’s Government in the Hong Kong S.A.R.to provide criticism,comments or advice on some specific opinions,behaviors and new situations from Hong Kong society,elaborate central government’s understanding of constitutional order in Hong Kong S.A.R.,eradicate the lack of“institutional identification”of Hong Kong society,and establish solid foundation of identification to implement the principle of“one country,two systems”comprehensively and correctly in Hong Kong S.A.R..
