摘要
粤港澳大湾区是具有区际性色彩的区域合作。作为新时期的一项新制度,目前欠缺直接可用的法律规制工具。在实定法上,现有的法律对此种合作本身的法律基础、法律效力以及有关合作主体的法律责任等方面内容缺乏直接规定。当前现状不仅导致其存在合法性及效力问题,更由于法律强制力的缺失,制度本身的实效性及操作性也受到了影响。有鉴于此,为妥善应对粤港澳大湾区本身的特殊性和复杂性,提供合法性基础以及有效的法律治理,当前有必要通过立法为其提供充分保障。具体而言,应当采取中央立法与地方立法相结合的立法进路,既要制定全国统一适用的"区域合作法",对区域合作的内容、效力和程序等基本问题做出规定,使粤港澳大湾区于法有据、有法可依,从整体上形成立法对制度的引领作用;又要在具体规划过程中重视地方立法的优势,允许地方立法在宪法和法律的框架下充分发挥自主作用,以有效应对区域合作中可能出现的各种潜在问题,亦保证制度运作中基本的效率优势。
The Guangdong-Hong Kong-Macao Greater Bay Area is a kind of regional cooperation which involves inter-regional element.As a new institution in the new period,there are no direct legal tools available.In positive law,the existing legislations lack direct provision on the legal foundation,the legal effect and the legal responsibility of the cooperating subject for such cooperation.The current situation may not only cause the problems of legitimacy and validity,but also affect the effectiveness and operability because of the absent of legal forces.In view of this,in order to cope with the particularity and complexity of the Guangdong-Hong Kong-Macao Greater Bay Area and offer the legal basis and effective legal governance to it,legislations are needed to provide adequate guarantee at present.Specifically,the way of combination of the national and local legislation should be taken.On one hand,"the Regional Cooperation Act"containing the content,effectiveness and procedures of regional cooperation should be enacted to assure that the Guangdong-Hong Kong-Macao Greater Bay Area has legal basis.On the other hand,it is also important to emphasize the advantages of local legislation in the specific planning process and allow local legislation to play its full independent role within the framework of the constitution and law,in order to deal with various potential problems in regional cooperation and ensure the efficiency in the institution.
