摘要
“慎诉”即慎重起诉,是宽严相济刑事司法政策在程序法中的具体体现,揭示出宽严相济刑事司法政策与起诉必要性审查制度的位阶关系和起诉必要性审查制度与相对不起诉制度的因果关系。然而,“慎诉”视阈下却存在起诉必要性审查不足和相对不起诉制度虚置的问题。因此,应明确起诉必要性审查在人权保障、检察履职、诉讼经济方面的价值追求和利益考量,将预防性司法和恢复性司法相结合,贯彻落实刑事司法政策和制度的要求。并在此基础上,完善以程序推进机制、要件判定机制、配套补充机制为主体的起诉必要性审查制度,促进检察机关能动履职,提高诉源治理能力。
“Cautious prosecution”is a specific implementation of the policy of balancing leniency and severity in criminal justice in procedural law,revealing the hierarchical relationship between the policy of balancing leniency and severity in criminal justice and the necessity review system of prosecution,as well as the causal relationship between the necessity review system of prosecution and the relative non prosecution system.However,under the perspective of“cautious prosecution”,there exist issues such as insufficient necessity review of prosecution and inadequate implementation of the relative non prosecution system.Therefore,it is necessary to clarify the value pursuit and interest consideration of necessity review of prosecution in terms of human rights protection,procuratorial performance,and litigation economy,and combine preventive and restorative justice to implement the requirements of criminal justice policies and systems.On this basis,we will improve the necessity review system of prosecution,which is mainly composed of procedural advancement mechanism,criteria determination mechanism,and supporting supplementary mechanism,thereby promoting active performance of the procuratorial organs and enhancing the ability to govern prosecution source.
