摘要
数字孪生作为数字技术革命发展的产物,具有虚拟化、实时性、精准映射的特性,被视为未来制造业企业转型发展的重要推动因素。数字孪生技术正处于萌芽期至蓬勃期的发展阶段,因其高精度建模、多源数据融合及算法创新的技术复杂性而易构成技术壁垒,需要通过知识产权手段保障企业内化数字孪生技术。制造型企业在内化数字孪生技术时内部面临着数据治理漏洞与权属管理缺失的知识产权风险;外部则面临着跨国技术窃取与知识产权法律冲突的风险。内外部交织、技术法律复合知识产权风险下,制造业企业同样面临着法律滞后、技术适配不足及标准缺位的知识产权保护障碍。基于此,制造业企业首先应当明确规划合适的知识产权保护形式,再针对数字孪生技术发展规划,采取分步骤的知识产权策略,促进数字孪生技术知识产权与规则建设之间的良性互动,增强本土制造型企业的高精尖技术竞争力。
As an outcome of the digital technology revolution,digital twin(DT)exhibits characteristics of virtualization,real-time capability,and precise digital mapping,and is regarded as a critical driver for the transformational development of manufacturing enterprises.Currently in its nascent-to-prosperous developmental stage,DT technology's technical complexity-manifested in high-precision modeling,multi-source data fusion,and algorithmic innovation-readily constitutes technical barriers,necessitating intellectual property(IP)safeguards for enterprise internalizing DT technology.In the process of internalizing DT technology,manufacturing enterprises face internal IP risks including data governance loopholes and lack of ownership management,while externally confronting risks of transnational technology misappropriation and legal conflicts in IP law.Under these interwoven internalexternal and techno-legal composite IP risks,enterprises also encounter IP protection impediments such as legal lag,insufficient technology adaptation,and absence of standards.Therefore,manufacturing enterprises should first delineate appropriate IP protection modalities,then adopt a phased strategy formulation aligned with DT technology development plans.This promotes a virtuous interaction between DT related IP rights and regulatory frameworks,ultimately enhancing domestic manufacturers'competitiveness in high-precision and cutting-edge technologies.
