The Original Contribution of Xi Jinping Thought on the Rule of Law to the Foreign-related rule of Law

摘要统筹推进国内法治和涉外法治是习近平法治思想的重要内容,习近平法治思想更对涉外法治的理论创新和实践发展作出贡献。涉外法治作为国内法治与国际法治的纽带,兼具国内法治和国际法治性质。故在统筹推进国内法治和涉外法治的过程中,应强调顶层设计、通盘筹划。在涉外法治建设中,既要从战略的高度加快涉外法治工作布局,也要加强涉外法治体系和能力的建设,更要在尊重国际法的基础上明确中国参与全球治理的立场。因此,一方面,应推动法治思维和方法在国际法领域的运用,助力中国自主的国际法知识体系构建。另一方面,应加强高素质涉外法治人才培养,在明确目标的基础上加快人才培养模式的融通转型,重视国际法学的教育与学科建设,为涉外法治建设提供人才支持。 The integrated promotion of the rule of law at the national level and the rule of law in relation to foreign countries is an important element of Xi Jinping Thought on the Rule of Law,and Xi Jinping Thought on the Rule of Law in relation to foreign countries contributes to theoretical innovations and practical development.As the link between the rule of law at the national level and the rule of law at the international level,the rule of law in relation to foreign countries is both national and international in nature.Therefore,in promoting the rule of law at the national level and the rule of law in relation to foreign countries,emphasis should be placed on top-level design and overall planning.In the construction of the rule of law in relation to foreign countries,it was necessary not only to accelerate the layout of rule of law work in relation to foreign countries at a strategic level,but also to strengthen the construction of the rule of law system and capacity in relation to foreign countries,and even more importantly,to make clear China's position on participation in global governance on the basis of respect for international law.Therefore,on the one hand,the application of rule of law thinking and methods in the field of international law should be promoted to help build China's own international law knowledge system.On the other hand,it should strengthen the cultivation of high-quality foreign-related rule of law talents,accelerate the integration and transformation of the talent cultivation mode on the basis of clear objectives,and pay attention to the education and discipline construction of international jurisprudence,so as to provide talent support for the construction of foreign-related rule of law.
