摘要
引渡替代措施具有适用灵活、形式多样等显著优势,能够有效应对20世纪以来跨国犯罪的新态势,在国际逃犯移交合作中发挥着日益重要的作用。由于规则体系构建滞后、受政治议程影响等多重因素,当前我国引渡替代措施实践遭遇阶段性瓶颈。为有效解决该问题,在顶层设计层面,应当明确开展引渡替代措施合作的基本原则;切实提升司法人权保障水平,增强中国人权话语权;稳步推进移交逃犯合作“三步走”战略。在具体规则层面,应当在《引渡法》修订时增订参照适用条款,构建宏观法律框架;通过法律解释明晰各类引渡替代措施的实施规范;关注量刑问题,分类界定“量刑承诺”的法律效力。顺应新时期移交逃犯模式从司法法范式向行政法范式变迁的趋势,提升我国国际追逃追赃工作的规范性和有效性。
Alternative Measures of Extradition possess notable advantages such as flexibility in application and diversity in form,effectively responding to the new trends of transnational crime since the 20th century.They have played an increasingly important role in international cooperation on cross-border fugitive pursuit.However,due to factors such as the lag in rule system construction and the influence of political agendas,the current practice of Alternative Measures of Extradition in China has encountered a temporary bottleneck.Therefore,at the top-level design stage,it is necessary to clarify the fundamental principles for cooperation in Alternative Measures of Extradition;effectively enhance judicial human rights protections and strengthen China's discourse power on human rights;and steadily promote the"three-step strategy"for cross-border fugitive transfer cooperation.At the specific regulatory level,the revision of the Extradition Law should include Reference Applicable Clauses to establish a macro legal framework.Legal interpretation should be utilized to clarify the implementation standards of various Alternative Measures of Extradition.At the same time,attention should be given to sentencing issues,with a categorized definition of the legal effect of Sentencing Commitment.Following the trend of shifting fugitive transfer models from the judicial law paradigm to the administrative law paradigm in the new era,China should enhance the standardization and effectiveness of its international efforts in cross-border fugitive pursuit and asset recovery.
