摘要
依托于数字营商环境的宏观叙事结构,数字技术跃升改变了法律适用的传统情境和规则边界,削弱了地方立法质量评价结果回应机制的实际效能,阻碍了数字法治体系发展,成为现代化建设的制约瓶颈。据此,地方立法质量评价结果回应机制需锚定多元价值追求,探索公平与效率之间的平衡点,挖掘回应型法中隐含的前瞻主义,并通过数据赋能驱动营商环境建设。回应机制设定机理的阐释,不仅要求理清性质变革与找寻路径模式,还应当科学设定回应机制规范依据。具而化之,亟需明确理性主义对回应型法治理念的导向与匡正,系统性地重构回应机制规范体系,通过设立责任监督机制实现各主体的协调统一,推动评价结果的高效转化与应用,以数字营商环境法治化促进经济社会的高质量发展。
Relying on the macro structure of the digital business environment,the leap in digital technology has changed the traditional context and rule boundaries of legal application,weakened the actual effectiveness of the response mechanism for evaluating the quality of local legislation,hindered the development of the digital rule of law system,and become a constraining bottleneck of modernisation.Accordingly,the response mechanism for evaluating the quality of local legislation needs to anchor the pursuit of multiple values,explore the balance between fairness and efficiency,tap the foresight implicit in the responsive law,and promote the institutional construction of the business environment through data empowerment.The explanation of the mechanism of response mechanism requires clarifying the nature of the change and finding the path model.In addition,it should scientifically set the normative basis of the response mechanism.Specifically,it is necessary to clarify the orientation and correction of rationalism to the concept of responsive rule of law,systematically reconstruct the normative system of the response mechanism,realise the coordination and unity of key organs through the establishment of the responsibility and supervision mechanism,and promote the efficient transformation and application of the evaluation results,so that the rule of law of the digital business environment can promote the high-quality development of the economy and society.
