摘要
随着人工智能技术的飞速发展,其生成物在文学、艺术、科学等领域的应用日益广泛,并引发了一系列著作权问题。关于人工智能生成物是否具有可著作权性,学术界存在肯定说与否定说,关键在于其是否满足作品的独创性和智力成果属性。在著作权归属问题上,现行法律体系尚未明确界定,存在多种观点,如归属于开发者、赋予人工智能拟制法律人格或直接进入公共领域等。针对著作权侵权问题,有关部门需明确侵权判定与责任归属,并采取一系列措施,如限缩性保护期限、明确合理使用例外、建立强制署名制度和完善侵权责任制度等,以实现技术创新与著作权保护的双赢。
With the rapid development of artificial intelligence technology,its generated works are increasingly applied in literature,art,science and other fields,which has triggered a series of copyright issues.Regarding whether Al-generated works are copyrightable,there are affirmative and negative views in the academic circle,with the key lying in whether they meet the originality and intellectual property attributes of works.As for the issue of copyright ownership,the current legal system has not clearly defined it,and there are various viewpoints,such as attributing it to the developer,granting artificial intelligence a fictitious legal personality,or directly placing it in the public domain.In response to copyright infringement issues,relevant departments need to clarify the determination of infringement and the attribution of liability,and take a series of measures,such as limiting the protection period,clarifying the exceptions for fair use,establishing a mandatory attribution system,and improving the infringement liability system,to achieve a win-win situation between technological innovation and copyright protection.
