摘要
养老合作社的社会功能继承了社会保障制度中的互助共济思想,其经济功能有助于互助养老服务的普惠型供给,其发展意义在于构建多元化养老服务体系,为农村突破养老困境提供可能的实现路径。实践表明,农村发展养老合作社面临法治供给不足、可持续发展受阻、风险防范措施有限等现实困境。为突破困境,在宏观层面应当明确养老合作社的特别法人地位,并且选择合适的立法模式,为养老合作社发展提供法律支持;在微观层面应构建多元化资金筹集机制,拓展失能老年人的非正式照护方式,明晰相关主体的责任范围,健全风险防范制度,为养老合作社的持续运行贡献法治力量。
The social function of eldercare cooperatives inherits the mutual assistance spirit from the social security system,while their economic function facilitates the provision of universally accessible mutual assistance elderly care services.Their developmental significance lies in constructing a diversified elderly care service system that offers a potential pathway for rural areas to overcome eldercare challenges.Practice has shown that rural development of eldercare cooperatives face practical difficulties such as insufficient legal support,obstacles to sustainable development,and limited risk prevention measures.To overcome these issues,at the macro level,the special legal status of eldercare cooperatives should be clearly defined and suitable legislative models selected to provide legal backing;at the micro level,a diversified funding mechanism must be established,informal care options for the disabled elderly expanded,responsibilities among stakeholders clarified,and risk prevention systems improved thereby contributing legal strength to their sustained operation.
