摘要
党的十八大以来,全党贯彻中央八项规定精神,党风政风焕然一新、社风民风持续向好,“八项规定改变中国”为全党全社会广泛认可。法治思维和法治方式贯穿于中央八项规定的制定和实施过程中,研究“八项规定改变中国”的法治意蕴,是透过中央八项规定更加深刻理解中国特色社会主义法治体系的必要之举。中央八项规定精神是中国特色社会主义法治体系的重要组成部分,是加强党的作风建设的法律渊源。“八项规定改变中国”的法治表现可以概括为立信、明矩和铸魂三个方面,遵循“形成—实施—溢出”的法治机理,是“通过法治的社会治理”在党的作风建设领域的直观体现。
Since the 18th National Congress of the Communist Party of China,the Party has thoroughly implemented the spirit of the Eight-Point Regulation of the Central Committee,leading to a remarkable transformation in Party and government conduct and continuous improvements in social ethos and public morality."The Eight-Point Regulation Changed China"has been widely recognized by the Party and society.The formulation and the implementation of the Eight-Point Regulation are guided by rule-of-law thinking and approaches.Therefore,studying the rule of law implications of this phenomenon is essential for gaining a deeper understanding of the socialist rule of law system with Chinese characteristics.The spirit of the Eight-Point Regulation constitutes a vital component of this system and serves as the legal foundation for enhancing the Party's conduct style.The rule of law manifestations of"The Eight-Point Regulation Changed China"can be summarized in three dimensions:establishing trust,clarifying norms,and forging values,following the legal logic of"formation—implementation—spillover,"and serving as a direct reflection of"social governance through rule of law"in the field of the Party's conduct construction.
