摘要
检察机关是行刑衔接的重要枢纽,探讨数字检察赋能行刑衔接意义重大。数字检察与行刑衔接均以系统治理为目标,前者能够提升行刑的衔接紧密度、畅通后者的信息共享渠道、优化后者的部门协同机制,因此数字检察能够为行刑衔接赋能。在赋能路径上,应当进行类型化构建,使数字检察在最狭义和狭义行刑衔接中发挥直接作用、在广义和最广义行刑衔接中发挥间接作用,同时要区分检察机关在行刑衔接中的参与者和监督者双重角色,分别进行事中赋能和事后赋能。
The procuratorate is an important hub in the connection between administrative procedure and criminal procedure.It is of great significance to explore the empowerment of digital prosecution in the connection between administrative procedure and criminal procedure.We should clarify the institutional positioning of the connection between administrative procedure and criminal procedure,as this will directly influence the feasibility,the scope,operational model,and power limits of the empowerment of digital prosecution.Meanwhile,there is deep alignment in philosophy and mechanism between digital prosecution and the connection between administrative procedure and criminal procedure:both share a common goal of systemic governance,while the former can enhance the coherence of the connection,facilitate smoother information sharing,and optimize inter-departmental coordination mechanisms of the latter.Therefore,digital prosecution can effectively empower the connection between administrative procedure and criminal procedure.In terms of empowerment pathways,we should choose typified construction,so that digital prosecution can play a direct role in the connection in the narrow and narrowest sense as well as an indirect role in the broad and broadest sense.According to procuratorate′s different roles as a participant or a supervisor in the connection between administrative procedure and criminal procedure,digital prosecution can empower the connection during or after the case respectively.
