摘要
数字技术在逮捕制度中的应用已经可以覆盖逮捕的全部流程,典型如数字监管技术、以大数据技术为驱动的逮捕社会危险性量化评估和逮捕审查程序的数字化。数字时代逮捕制度的变革,应当坚持数字赋能、正当程序和比例原则等基本理念。在功能设定方面,应当限制逮捕作为社会防卫措施的功能,促使逮捕主要功能逐步回归至确保刑事诉讼顺利进行的程序保障功能上来。在此基础上,逮捕社会危险性条件应当依据基于确保刑事诉讼顺利进行的逮捕和基于实现社会防卫目的的逮捕而分别设定,应当提升逮捕社会危险性条件的实质化审查程度并推动羁押听证程序的诉讼化发展。
The application of digital technology in the arrest system can already cover the entire process of arrest,with typical examples being digital supervision technology,big data-driven quantitative assessment of social risks,and the digitization of arrest review procedures.The reform of the arrest system in the digital age should adhere to the basic concepts of digital empowerment,due process,and the principle of proportionality.In terms of functional settings,the function of arrest as a social defense measure should be limited,prompting the gradual return of the primary function of arrest to ensuring the smooth progress of criminal proceedings.On this basis,the conditions for the social risks associated with arrest should be set separately based on arrests aimed at ensuring the smooth progress of criminal proceedings and arrests aimed at achieving social defense purposes.Additionally,the substantive review of the conditions for the social risks associated with arrest should be strengthened,and the litigious development of detention hearing procedures should be promoted.
