摘要
建设数字法治政府是浙江省建设法治中国示范区的重要内容,近年来浙江省逐渐从建设法治政府、数字政府过渡到建设数字法治政府,公共数据的授权运营制度为两者融合建设搭建了桥梁。公共数据的授权运营对激活数据要素价值,推动我国数字经济发展与数字法治政府建设具有重要意义。近年来,浙江省围绕公共数据共享开放、开发利用开展探索,积极推动公共数据授权运营,并通过出台地方性法规、政策文件等措施初步构建了公共数据授权运营制度。但目前的公共数据授权运营在实践中存在着运营领域比较单一、容易导致垄断等风险,即阻碍了公共数据释放其应有价值,也不利于数字法治政府的健康发展。鉴于此,在浙江省大力推动建设法治中国示范区的背景下,结合现有法治政府与数字政府发展的丰富实践,以浙江省公共数据的授权运营着眼点,力图为浙江数字法治政府的建设路径提供一种新的思考角度。
Building a digital rule of law government is an important aspect of Zhejiang Province’s efforts to create a demonstration zone for the rule of law in China.In recent years,Zhejiang has transitioned from focusing solely on building a rule of law government or a digital government to integrating the two into a digital rule of law government.The authorized operation of public data has served as a bridge facilitating this integration.The authorized operation of public data plays a significant role in unlocking the value of data elements and promoting the development of China’s digital economy and the construction of a digital rule of law government.Zhejiang has actively explored the sharing,opening,and utilization of public data,promoting its authorized operation through local regulations and policy documents,thus laying the groundwork for a system of public data authorized operation.However,current practices in public data authorized operation face challenges such as limited scope of operation and risks of monopoly,which hinder the full realization of public data’s potential value and are not conducive to the healthy development of the digital rule of law government.Given this,against the backdrop of Zhejiang’s strong push to build a demonstration zone for the rule of law in China,and drawing on the extensive experience in the development of the rule of law and digital governments,this approach takes the authorized operation of public data in Zhejiang as a focal point,aiming to provide a new perspective on the development path for Zhejiang’s digital rule of law government.
