摘要
自动驾驶汽车的交通事故侵权责任主体认定不同于普通机动车交通事故侵权的责任认定,对传统的过错责任和产品责任的适用提出了挑战。目前,《中华人民共和国民法典》和《中华人民共和国道路交通安全法》尚未明确给出自动驾驶汽车交通事故侵权责任的认定规则,法学界对该问题也是众说纷纭。在现行侵权法律框架下,文章从解释论视角分析了自动驾驶汽车交通事故责任认定的困境,对驾驶自动化不同阶段适用的不同侵权责任模式进行分析,进而提出应进一步完善技术标准体系,在机动车保有人、交通事故受害者与自动驾驶汽车生产者之间取得利益的平衡。
Unlike traditional motor vehicles,the determination of tort liability of autonomous vehicles challenges traditional fault liability and product liability.At present,there are not yet clear provisions in the Civil Code and Road Traffic Safety Law for such cases,and the legal community is divided on the issue.Under the current legal framework,the article examines the dilemma of liability determination of autonomous vehicle from the perspective of interpretive theory,elaborates on different modes applicable to different stages of driving automation,and then proposes that the technical standard should be further enhanced to seek for a balance of interests between motor vehicle owners,accident victims and autonomous vehicle manufacturers.
