摘要
生成式人工智能快速发展正深刻影响人类社会,也在很大程度上形塑着犯罪与侦查,从而使犯罪、侦查、人工智能技术产生了复杂的关系。智能化技术进步创造了犯罪之可能,隐蔽式数据获取为深度伪造提供了基础,无限性程序迭代则生成了内核动力,这些都是生成式人工智能形塑犯罪之具体面向,并由此催生出“深度伪造型犯罪”。在生成式人工智能影响下,侦查与犯罪之间发生了具有诸多新特点的博弈,其通过博弈的基础焦点、信息焦点、策略焦点得以集中呈现,亦使侦查与犯罪孰优孰劣地位处于动态变化中,而在这背后的核心驱动力是作为生成式人工智能核心技术的“深度学习”。着眼未来,侦查活动应充分利用生成式人工智能技术赋能,促成传统侦查模式向智慧侦查模式转型,在这个过程中应聚焦不同的博弈焦点,保持侦查之于犯罪的优势地位,具体可从4个方面着力:一是转变侦查理念,从“经验主义”迈向“智能主义”;二是革新侦查重点,从关注实体物体转变为重视数据信息;三是前置犯罪打击,从线下打击渐进前移至线上侦防;四是扩大侦查协作,从一元主体过渡到多元协作。
The rapid development of generative artificial intelligence has a profound impact on human society,and also shapes crime and investigation to a large extent,resulting in a complex relationship among crime,investigation,and artificial intelligence technology.Progresses in intelligent technology creates the possibility of crime,covert data acquisition provides the basis for in-depth forgery,and infinite program iteration generates internal driving force.All these are the specific factors with which generative artificial intelligence reshapes crimes,and thus give birth to“in-depth forgery-type crimes”.Under the influence of generative artificial intelligence,a fierce game between investigation and crime has occurred with many new features.The game is presented through focusing on its foundation,information,and strategy,and also makes the superiority and disadvantage of investigation and crime in a dynamic status.The core driving force behind this is“deep learning”,which is the core technology of generative artificial intelligence.With an eye to the future,investigation activities should make full use of generative artificial intelligence technology to promote the transformation of traditional investigation mode to intelligent investigation mode.In this process,the dominant position of investigation over crime should be maintained by focusing on different games.Specifically,four aspects should be concentrated on.Firstly,the concept of investigation should be changed from“empiricism”to“intelligentism”.Secondly,the focus of investigation should be innovated from focusing on physical objects to focusing on data information.Thirdly,crime fighting scene should be changed from offline to online.and fourthly,the collaboration of investigation should be expanded from the single body to multiple collaborative agencies.
