摘要
我国国家纪律处分体系在规范公职人员行使公权力方面具有不可忽视的作用。该体系经历了国家纪律狭义单轨处分制时期、国家纪律广义单轨处分制时期以及国家纪律双轨处分制时期。该体系在演变轨迹上表现为:处分主体由一元走向二元;处分对象由部分走向全部;处分事由由分散走向统一。该体系在演变特征上呈现为:法治化是国家纪律处分体系演变的主要方向;政治性是国家纪律处分体系演变的不变主题;反腐败斗争是国家纪律处分体系演变的重要动因;强制性变迁是国家纪律处分体系演变的主要路径。
China's national disciplinary system has a significant role in regulating the exercise of public power by public officials.The system has gone through a period of single-track disciplinary system in the narrow sense,a period of single-track disciplinary system in the broad sense and a period of double-track disciplinary system in the state discipline.The system has evolved from a monolithic to a binary disciplinary body,from a partial to a total disciplinary target,and from a fragmented to a unified disciplinary matter.The evolution of the system is characterized by:rule of law is the main direction of the evolution of the national disciplinary system;political nature is the constant theme of the evolution of the national disciplinary system;anti-corruption struggle is the important motive of the evolution of the national disciplinary system;mandatory change is the main path of the evolution of the national disciplinary system.
