摘要
《关于办理侵犯公民个人信息刑事案件适用法律若干问题的解释》第1条规定了刑法中的“公民个人信息”应具备可识别性。其对可识别性的定义建基于一定的解释逻辑,在一定程度上具有合理性,但同时也存在不可弥合的固有缺陷。为保障侵犯公民个人信息罪的准确理解与合理适用,有必要对《解释》的内容进行一定程度的调整,进而完成“公民个人信息”可识别性的意蕴重释。具体而言,在识别方式上,间接识别并非没有任何限制,与其他信息结合才具有可识别性的信息自身必须对特定自然人的身份识别具备一定的实质意义;在识别对象上,不具备身份识别性的单纯的活动信息不应被认定为属于“公民个人信息”的范畴;在识别标准上,确立广义的一般人标准,将需要耗费不合逻辑的成本才能进行身份识别的情形排除在外。
Article 1 of the Interpretation stipulates the identifiability of"citizensp'Iersonal information".Such a provision is based on a certain logic of interpretation,and,to some extent,has rationality.However,it also has inherent defects that cannot be bridged.In order to ensure the accurate understanding and law application of the crime of infringing on citizens'personal information,it is necessary to adjust the content of the Interpretation to a certain extent,and then reinterpret the identifiability of"citizens'personal information".Specifically,in terms of identification methods,indirect identification has some restrictions.Information that can be identified only when combined with other information must have certain substantive significance in identifying the specific natural person.In terms of identification objects,simple activity information that does not have identity recognition should not be recognized as belonging to the category of"citizens'personal information".In terms of identification criteria,it is necessary to establish a broader standard for ordinary people to exclude the situation that requires illogical costs for identity identification.
