摘要
中国式现代化要求“办好人民满意的教育”,建成“服务全民终身学习的现代教育体系”。现代教育事业的发展目标与终身教育“以人为本”及“教育贯穿终身”的发展理念一致,其实现需要良好的法治环境。在全面依法治国的宏观背景下,我国终身教育领域虽然经历了较长时间的法治探索与尝试,具备了一定的法治基础,但法治格局尚未形成。当前我国还存在终身教育法律体系不完整、法治行动力存在掣肘、终身学习权利观尚未形成等实践难点。中国式终身教育法治现代化要以基于终身教育理念的科学立法体系为法治基础,以支持服务全民终身学习现代教育体系的建立健全为法治行动目标,以促进公民终身学习权利从赋予走向实现为法治工作重心,以先进的法治理念与策略提升法治效能,将终身教育的思想、原则及方法转化为治理主体的实际行动,为公民终身学习的全面实现提供稳定、持久的外部环境,为世界教育的现代化提供中国方案,贡献中国智慧。
Chinese path to modernization requires“providing education that satisfies the people”and building a“modern education system serving the lifelong learning of the whole people”.The development goals of modern education are consistent with the development concept of“people-oriented”and“education runs through life”in lifelong education,and its implementation requires a good legal environment.Under the macro background of the comprehensive advancement of law-based governance,although the field of lifelong education in China has experienced a long period of exploration and attempts in the rule of law,forming a certain basis for it,the model of rule of law has not yet taken shape.At present,there are still some practical difficulties in China,such as the incomplete legal system of lifelong education,the constraints of legal action,and the failure to form the concept of lifelong learning rights.The Chinese modernization of the rule of law of lifelong education should take the scientific legislative system based on the concept of lifelong education as t he foundation,supporting the establishment and improvement of the modern education system to serve the whole people’s lifelong learning as the goal,and promoting the citizens’lifelong learning rights from empowerment to realization as the focus,to improve the effectiveness of the rule of law with advanced legal concepts and strategies.This modernization will integrate the principles and methods into practical actions of governance subjects,provide a stable and lasting external environment for the comprehensive realization of citizens’lifelong learning,and hence to provide Chinese solutions and Chinese wisdom to the modernization of world education.
