摘要
智能语音技术可以带来收益,但也存在技术误差、破解身份认证、信息泄露等法律风险。智能语音技术中的声音保护存在法律争议,这是与声音的人体生物特征、声音的法律属性争议相关的。声音属于个人生物信息,含有可识别性、稳定性、非匿名性、全向性等特征。对智能语音技术进行法律规制,有必要加大对生物识别信息现有立法的解释与完善;把握复杂的人机关系处理的法律规则;面对未知风险,要坚持从严解释弱风险预防原则,坚持发展智能语音技术的法律底线。
Intelligent sound technology can bring benefits,but there are also legal risks such as technical errors,cracked identity authentication,and information leakage.There is a legal dispute over sound protection in intelligent sound technology,which is related to the dispute over the human biological characteristics of sound and the legal attributes of sound.Sound belongs to personal biological information,which has the characteristics of identifiability,stability,non-anonymity,and omni-directivity.At present,the actual demand for intelligent sound technology and its research of object sound in China is increasing,but the supply of legislation is insufficient.It is urgent to strengthen the interpretation and improvement of the existing legislation of biometric information.It is necessary to grasp the legal rules of complex human-computer relationship.Facing unknown risks,we should adhere to the principle of strict interpretation of weak risk prevention,and grasp the legal bottom line of developing intelligent sound technology.
