摘要
微博民意在一定程度上有利于保障刑事司法的公开透明,民意的及时有效表达可以促进刑事司法实现法律效果与社会效果的统一。微博民意对于刑事司法公正也存在一定消极影响,比如,微博民意可能会侵犯公民隐私、干扰侦办程序、妨碍审判公正、损害司法权威等。合理的公众参与则是平衡微博民意与刑事司法公正的关键。实现微博民意与刑事司法公正之间的良性互动,应当完善民意甄别机制、人民陪审制度、庭审公开制度等。
To some extent,microblog public opinion is conducive to ensuring the openness and transparency of criminal justice,and the timely and effective expression of public opinion can also promote the unification of legal and social effects in criminal justice.However,microblog public opinion also has a certain negative impact on criminal justice.For example,microblog public opinion may infringe citizens privacy,interfere with investigation procedures,hinder judicial justice,and damage judicial authority.Reasonable public participation is the key to balance microblog public opinion and criminal justice.To realize the positive interaction between microblog public opinion and criminal justice,we should improve the public opinion screening mechanism,the people's jury system,the open court trial system and other measures.
