“人机共驾”智能汽车交通事故侵权车辆保有人责任研究

Research on the Tort Liability of the Owner of the Autonomous Vehicle in the "Human-machine co-driving" Traffic Accident

摘要 智能汽车带来便利的同时带来的交通事故说明亟待建立有关“人机共驾”智能汽车交通事故保有人侵权责任体系。在建立有关侵权责任体系前,应平衡好人与机器伦理价值选择以及法律与企业价值选择两组关系。在适用具体侵权责任时,相较共同过失侵权说、缺陷医疗产品侵权说以及动物侵权说等观点,应采取交通事故侵权说观点。在构建详细侵权责任时,归责原则可从过错原则和无过错原则展开,免责事由包括产品缺陷、销售商义务以及第三人原因三个方面。 While autonomous cars bring convenience, many traffic accidents indicate that it is urgent to establish a tort liability system for the owners of autonomous vehicle. Before establishing the relevant tort liability system, it is necessary to balance the choice between the ethical value of human and machine and the choice of legal and corporate value. When applying specific tort liability, compared with the theory of joint negligence tort, the theory of tort of defective medical products, and the theory of animal tort, the view of traffic accident tort theory should be adopted. When constructing detailed tort liability, the principle of attribution can be carried out from the principle of fault and the principle of no-fault. The reasons for exemption include three aspects: product defect, seller’s obligation and third-party reasons.
