摘要
以默示算法共谋为代表的算法垄断加剧了法律规制相较于算法科技的滞后性。传统算法解释权主要侧重于对算法施以合同为基础的私权规制,但其对于公平竞争秩序的法律保护显得捉襟见肘。双向驱动型算法解释工具是一种脱胎于传统算法解释权的新型数据治理工具,具有启动主体上的双向多元特征,能够最大限度调动多元公私主体发挥各自优势参与算法合作共治,并将算法解释和算法审查有机结合,开展算法规制和算法救济层面的实质审查。应从双向驱动型算法解释工具的启动主体与解释主体、解释原则与解释标准、解释审查机制的科学构建,以及修改垄断协议相关法律制度等维度,实现双向驱动型算法解释工具更优的数据治理绩效。
The algorithm monopoly represented by tacit algorithm collusion intensifies the lag of legal regulation compared with algorithm technology.The traditional algorithm interpretation power mainly focuses on the contract-based private rights regulation of the algorithm,but its legal protection for the fair competition order is limited.The two-way driven algorithm interpretation tool is a new data governance tool derived from the algorithm interpretation power,which has the characteristics of two-way diversity in the starting subject,and can maximize the mobilization of multiple public and private subjects to give full play to their respective advantages,participate in the co-governance of algorithm cooperation,and organically combine algorithm interpretation and algorithm review,realizing the substantive review principle at the level of algorithm regulation and algorithm relief.The legalization of the two-way driven algorithm interpretation tool should be realized from the dimensions of the starting subject and interpretation subject of the two-way driven algorithm interpretation tool,the interpretation principle and interpretation standard,the scientific construction of the interpretation review mechanism,and the modification of the legal system related to the monopoly agreement.
