摘要
通过对已有的黄河流域生态保护的立法进行文献分析以及规范分析,发现当下基础性及普适性法律在解决黄河流域现实问题方面还存在着较多不足:流域保护的法律规范的供给不足、法律规则的针对性不强、法律规定的协同性不够等,无法统筹解决黄河保护中的难题。在对既有法律存在的问题综合分析的基础上,提出进行专门的黄河流域保护立法,将流域立法的功能定位为综合保护法、协同保护法、特别保护法;将流域立法内容由冲突转为专项内容聚焦,在阐明黄河保护立法理念、立法原则以及重点内容聚焦的基础上,提出黄河保护立法的框架结构设想。
Through the literature analysis and normative analysis of the existing legislation of ecological protection in the Yellow River Basin,it is found that there are still many deficiencies in the current basic and universal laws in solving the practical problems in the Yellow River Basin:the supply of legal norms for river basin protection is insufficient,the pertinence of legal rules is not strong,and the coordination of legal provisions is insufficient,unable to comprehensively solve the problems in the protection of the Yellow River.Based on the comprehensive analysis of the existing laws,put forward the special protection legislation,turning the content of watershed legislation from conflict to special content,put forward the framework of the legislation on the basis of clarifying the legislative concept,legislative principles and focus on the key contents of the protection of the Yellow River.
