摘要
在线诉讼中,身份认证、诉讼文书、证据材料、第三方导入涉案数据等可能蕴含着相关人员的个人信息。《在线诉讼规则》要求在线诉讼中应遵循个人信息保护义务。但《个人信息保护法》为个人信息处理者创设了很多义务,若法院、当事人等主体在诉讼活动中完全遵循《个人信息保护法》中规定的个人信息保护义务,不仅会带来诉讼成本的大幅上升,也可能导致有些诉讼活动无法开展。审判公开、质证辩论是程序正义的重要内容,在线诉讼也应遵守程序正义的基本要求,但由此可能产生个人信息处理和公开。以个人信息保护为基点所构建的法律制度,可能并不完全适用于在线诉讼,它们存在适用范围和理论边界。但是,在线诉讼中实现程序正义也不能无视个人信息保护的合理需求,特别是对敏感个人信息的保护,否则就可能在纠纷解决和案件裁判中产生新的纠纷。故在线诉讼中需要实现程序正义和个人信息保护的有效平衡。
There is a great quantity of personal information in identity authentication,legal documents,evidences in online litigation.The Online Litigation Rules of the People’s Courts requires to protect personal information in online litigation.The Personal Information Protection Law (PIPL) creates many obligations for personal information processors.If the courts,parties and other subjects of online litigation fully comply with the obligations stipulated in PIPL,the litigation costs may increase too high to carry out.The procedural justice requires open trial and cross examination.The basic requirements of procedural justice should be complied in online litigation which may bring personal information processing and disclosure.The rules of PIPL may not be fully applied in online litigation and they have scope of application.However,the procedural justice of online litigation can not completely ignore protection of personal information especially sensitive personal information,otherwise new disputes may arise.It needs to keep balance between procedural justice and personal information protection in online litigation.
