摘要
党的十八大以来,生态环境保护成为了立法关注的重点领域,但现行生态环境立法决策体制还存在诸多问题,环境立法法典化被提上议事日程。习近平法治思想中的生态文明法治观在弘扬和创新“天人合一”中华法文化的基础上,阐明了坚持党的领导、坚持全过程民主立法、坚持山水林田湖草人系统立法等环境立法决策的系列新观点新理念,构成了新时代环境立法法典化的指导思想和方法论。为了建立完备的生态环境法律规范体系和法治保障机制,新时代环境立法法典化应以习近平法治思想为指引,以环境治理决策法为目标导向,促进环境保护法向环境政策法的基本法地位转变,落实重大决策党政同责的制度,进一步规范地方环境立法决策体制。
Since the 18th National Congress of the Communist Party of China(CPC),the protection of ecological environment has become the focus of legislation.Xi Jinping's thought on rule of law is based on promoting and innovating the excellent Chinese legal culture of“Unity of Heaven and Man”,which expounds a series of new viewpoints and ideas of environmental legislative decision-making,such as adhering to the leadership of the Party,adhering to democratic legislation throughout the whole process,and adhering to legislation of“mountains,rivers,forests,fields,lakes,grass,and human beings”as a system,which constitute the guiding ideology and methodology for the codification of environmental legislation in the new era.In order to establish a complete legal system and guarantee mechanism of the rule of law for the ecological environment,the codification of environmental legislation in the new era should be guided by Xi Jinping's thought of the rule of law and directed by the environmental governance decision-making law.We should promote the transformation of the status of the Environmental Protection Law into the Basic Law of Environmental Policy,implement the system of the Party and the government assuming the same responsibility for major policy decisions,and further standardize the decision-making system of local environmental legislation.
