摘要
随着国家监察体制改革的不断推进,政务处分作为一种新的处分类型出现。但政务处分的出现在整合处分权、实现对公权力监督全覆盖的同时,也导致了原行政监察权空置;政务处分与公职人员任免机关、单位处分的界限不明、衔接不畅等问题。以行政机关公务员为对象,在行政处分与政务处分并行,同党纪处分、刑罚处罚共同构成处分体系的前提下,可以尝试以行政机关承接原行政监察机关职能、发挥行政机关对监察机关的实质监督与制约效能、改变政务处分与行政处分择一适用的标准等方式,通过制度设计解决政务处分出现后所产生的实践问题。
With the reform of the national supervision systems,there craete a new type of punishment which called administrative discipline.But as whlie as Integrating the anti-corruption resources and achieving the full coverage of public power supervision,it has led to the vacancy of the original administrative supervision power,the unclear responsibilities of government punishment and the appointment and removal of public officials,and the poor connection.Targeting civil servants in administrative organs,on the premise that administrative punishment and administrative punishment go hand in hand and constitute a punishment system together with Party discipline punishment and criminal punishment.We can try to solve the practical problems after the emergence of administrative sanctions through system design by means of administrative organs undertaking the functions of the original administrative supervision organs,giving full play to the substantive supervision and restriction of administrative organs on the supervision organs,and changing the applicable standards of administrative sanctions and administrative sanctions.
