摘要
随着平台经济蓬勃兴起、纵深发展,世界范围内出现了数字平台滥用支配地位、排除限制竞争等突出问题,而且呈现愈演愈烈之势。如何构建平台经济治理体系,有效监管数字平台行为,已成为世界各国监管机构面临的一个极具挑战性的议题。欧美等发达经济体从完善监管政策、创新监管工具、加强监管协同等方面加快探索、积极应对。2021年以来,我国将强化反垄断和防止资本无序扩张作为一项重点工作,加快健全规则制度,加强反垄断监管执法,取得一定成效。但是,我国平台企业发展不规范、平台经济发展不充分的问题尚未根本性解决,需要把握发展规律、借鉴国际经验、立足中国实际,加快健全平台经济治理体系,推动我国平台经济规范健康持续发展。
With the vigorous rise and in-depth development of platform economy,prominent problems such as abuse of dominant position and exclusion and restriction of competition by digital platforms have emerged all over the world,and are becoming more and more intense.The issue of how to build a platform economy governance system and effectively supervise the behavior of digital platforms has become very challenging to regulators all over the world.Developed economies such as Europe and the United States have accelerated exploration and responded positively from the aspects of improving regulatory policies,innovating regulatory tools and strengthening regulatory coordination.Since 2021,China has focused on strengthening antitrust moves and preventing disorderly capital expansion,accelerated the improvement of rules and systems,tightened antitrust supervision and law enforcement,and achieved certain results.However,the problems of non-standardized development of China's platform enterprises and insufficient development of the platform economy have not been fundamentally solved.It is necessary to grasp the development law,learn from international experience while staying rooted in China's reality,accelerate the improvement of the platform economy governance system and promote the standardized,healthy and sustainable development of China's platform economy.
