摘要
土地承包经营权户内共同共有的核心在于强调农户家庭内部家庭成员对承包地不分份额地享有权利和承担义务,在地权固化背景下,土地承包经营权户内共同共有为有效化解无地农民的土地问题提供了新思路。然而,当前土地承包经营权户内共同共有存在着主体范围不清、客体来源不明、权利义务关系模糊不清等现实困境。完善土地承包经营权户内共同共有制度,需坚持土地承包关系“长久不变”和农民主体地位的政策原则,通过规范主体资格认定规则、界定客体来源范围与建立公平合理的权利行使与义务承担机制,科学构建土地承包经营权户内共同共有的制度体系,提升土地承包经营权户内共同共有的运作效能。
The core of indoor common ownership of land contractual management right is to emphasize that family members within farmers′families enjoy the rights and obligations of contracted land regardless of share.Under the background of land right solidification,indoor common ownership of land contractual management right provides a new idea for effectively resolving the land problem of landless farmers.However,at present,there are some practical difficulties in the indoor common ownership of land contractual management right,such as unclear subject scope,unclear source of object,and ambiguous relationship between rights and obligations.To improve the common ownership of land contractual management rights,we need to adhere to the policy principles of"long-term invariability"of land contractual relations and farmers′subject status,and scientifically build a common system of land contractual management rights by standardizing the rules for the identification of subject qualifications,defining the source scope of objects and establishing a fair and reasonable mechanism for the exercise of rights and obligations,which can improve the common operation efficiency of land contractual management rights.
