摘要
以“两权分立”为主要内容的现行宅基地制度在不断推进的城镇化进程中面临闲置化、非资格占用、市场化退出困难等问题的挑战。导致宅基地利用出现以上状况的原因在于现行宅基地制度的福利性、封闭性、僵化性。在城乡融合发展视野下推动宅基地制度“三权分置”改革,须推行宅基地有偿使用与退出以落实集体掌握的宅基地所有权,完善宅基地的用益物权权能以保障农户享有的宅基地资格权,同时扩大宅基地产权结构的开放性以放活宅基地使用权使其可为集体外组织或人员获得,从而推动城乡土地不断融合。
The current homestead system with“separation of rights”as the main content is confronted with challenges such as idling,non-qualified occupation and marketization-quitting problem in the urbanization pro-cess.The reasons for the above situation of homestead utilization are the welfare,closure and rigidity of the cur-rent homestead system.In the perspective of urban-rural integration to promote the reform of“separation of three rights”of homestead system,it is necessary to implement the paid use and withdrawal of homestead to im-plement the ownership of homestead owned by the collective,complete the usufructuary right of homestead to guarantee the qualification right of homestead owned by farmers,and expand the openness of the property right structure of the homestead to free the right to use the homestead so that it can be acquired by outside collective organizations or personnel.
