摘要
财产权和乡村内部治权是乡村秩序的基础,宅基地产权和治理规则是乡村稳定与发展的重要内容。建国以来宅基地制度演进的基本逻辑是以保障居住功能弱化财产权利、为了耕地保护削弱乡村内部治权,从而国家公权支撑的“管制”权不断强化。“强管制,弱产权”的宅基地制度安排导致管制无效和产权无效。国家主导的宅基地制度改革顶层设计朝着强化管制、有限开放产权的方向进行,地区试点的制度创新明显朝向寻求有效治理和显化财产权利。浙江义乌、四川泸县、江西余江的试点昭示了朝向有效产权、村内治权与国家有限管制的宅基地改革方向。
Property rights and rural internal governance are the basis of rural order.The property rights and governance rules of the homestead play an important role in rural stability and development.Since the founding of the People’s Republic of China,the evolution of the Homestead System took place according to the logic of weakening property rights by protecting the residential function,weakening rural internal governance for the protection of cultivated land,and strengthening regulation rooted in state public rights.The homestead system arrangement of Mstrong regulation,weak property rightsM led to the inefficiency of regulation and the inefficiency of property rights.The state-led homestead system reform is moving toward strengthening regulation and limited access of property rights.The institutional innovation in regional pilots is clearly oriented towards seeking effective governance and explicitation of property rights.The cases of Yiwu city,Luxian county,and Yujiang district suggest the direction of homestead reform towards effective property rights,effective rural governance as well as limited state regulation.
