民法典时代我国婚姻住所制度实现机制研究被引量：2

On the Realization Mechanism of the Matrimonial Domicile System in China in the Era of Civil Code

摘要婚姻住所承载家庭精神利益与情感寄托,区别于一般不动产,配偶单方处分或设定负担行为不应简单套用物权变动规则发生效力。我国既有制度因缺乏家事法特殊性考察,未认真对待家庭关系团体性、协力性特质,规范适用存在民事交易财产法异化婚姻关系伦理性之风险。民法典时代,不宜通过顶层设计路径探究我国婚姻住所制度构建方案,应诉诸法解释学,重视优良家风条款法益创设功能,借鉴英国、德国等国家或地区婚姻住所制度实践,通过《民法典》既有规则的联动作用,限制个人所有权恣意行使,从严认定善意取得主观要件,间接达致婚姻住所制度社会效能。婚姻关系存续期间,配偶一方对婚姻住所的处分或设定负担行为,在征得另一方配偶同意前应属效力待定,离婚后通过设定居住权、租赁合同方式保障弱势一方居住利益。 Matrimonial domicile,which is different from general real estates,carries spiritual benefits and emotional sustenance of a family.The spouse’s unilateral punishment or burden-setting should not simply apply the change rules of property rights in order to take effect.The existing system in China lacks the specialty of family law,and does not take seriously the group or cooperative characteristics of family relations.The application of the rules of civil law of property transaction has the risk of alienating the ethics of marriage relations.In the era of civil code,it is not very appropriate to explore the construction plan of China’s matrimonial domicile system through the top-level design.It should resort to legal interpretation,pay attention to the creation of clauses for a good family style,and learn from the practice of the matrimonial domicile systems in Britain,Germany and other countries or regions.Through the linkage function of the existing rules in Civil Code,it is possible to restrict the arbitrary exercise of individual ownership,and strictly affirm the acquisition of subjective elements in good faith,which indirectly achieves the social effectiveness of the matrimonial domicile system.In the duration of the marriage,the action of one spouse on the disposition of the matrimonial home or the setting of burdens shall be valid until the consent of the other spouse is obtained.After the divorce,the housing interests of the disadvantaged party shall be protected through the establishment of residence rights and lease contracts.
