摘要
中国乡村四十年来发生了翻天覆地的巨大变化,不但人们彼此之间的生产关系及生活关系等发生了前所未有的巨变,而且人们用以调整诸多社会关系的方式及路径等也大不同于以前。不论是内地以劳务输出为主的乡村,还是沿海以劳务输入为主的乡村,生产关系及生活关系的主要内容已经普遍权利化了,乡村秩序在一定程度上就是不同主体之间的权利秩序。人们各自权利的实现程度依赖于不同主体之间法律关系的完善与合理的程度,而这又取决于其治理框架的合理程度及其法制化的建构水平。中国乡村治理已经形成了多元协商民主治理的框架,处理好这个治理框架内的权利秩序安排、法律关系调整及框架本身的法制建构,是中国乡村治理体系和治理能力现代化的题中应有之义。
Great changes have taken place in China’s rural areas in the past 40 years.Not only have the relations of production and life between people changed dramatically,but also the ways and paths that people used to adjust many social relations are different from those before.Whether it is the rural areas mainly engaged in labor export in the mainland or in the coastal areas where labor services are mainly imported,the main contents of production relations and life relations have been universally righted,and the rural order is,to a certain extent,the right order among different subjects.The realization of people’s rights depends on the perfection and rationality of the legal relationship between different subjects,while the perfection and rationality of the legal relationship depends on the rationality of the governance framework and the construction level of its legalization.China’s rural governance has formed a framework of pluralistic deliberative democratic governance.It is necessary to deal with the arrangement of the right order,the adjustment of legal relations and the construction of legal system within the framework of governance.
