摘要
近十年来,世界上很多国家对外商投资进行了日益严苛的国家安全或利益的审查,该制度日渐成为贸易保护主义的工具。我国作为多边主义和自由贸易的坚定维护者,需要进一步对外开放和吸引外资,以在全球激烈的竞争中取得主动。因此,我国在实施对外商投资的国家安全审查时需要走法治化之路。可以采用的路径包括推动审查标准的类型化和指标化,提高审批的透明度、参与性和有效回应投资者关切。这些措施有助于降低外国投资者对国家安全固有的政治偏见和顾虑,更好地提高我国的营商环境。
In the past ten years,many countries in the world have conducted increasingly stringent national security/interest reviews on foreign investments,and the system has increasingly become a tool of trade protectionism.As a staunch defender of multilateralism and free trade,China needs to further open up to the outside world and attract foreign capital in the fierce global competition.Therefore,when carrying out the national security review of foreign investment,China needs to follow the rule of law.Relevant measures may include promoting the typification and indexation of review standards,improving transparency and participation as well as effectively responding to concerns of foreign investors.They are beneficial to reduce the inherent political prejudice and concerns of foreign investors on“national security”review and better improve China s business environment.
