摘要
性侵未成年人的犯罪,在许多国家从来都是具有严重社会危害性的犯罪。在我国的法治建设过程中,虽然在理论基础上刑法对于此类犯罪的规制呈现出从严的趋势,但是刑法本身的理论特性导致对性侵未成年人尤其是性侵幼女犯罪规范层面还存在一定的缺陷。因此,厘清此类犯罪的罪状之间的关系,明晰刑法规定的加重情节的司法认定,对主观上的“明知”及客观上是否达到入罪标准的认定,要结合主客观相一致的原则,对“在公共场所当众”情节的认定要多样化理解。努力构造以预防、惩治为核心的多元化保护体系尤为重要。
Sexual assault on minors has always been a serious socially harmful crime in many countries.In the process of building the rule of law in China,although on the theoretical basis,the criminal law has shown a stricter trend in regulating such crimes.However,due to the theoretical characteristics of the criminal law itself,there are still some shortcomings in the standard of sexual assault on minors.Therefore,to clarify the relationship between the guilt of such crimes,to clarify the judicial determination of aggravating circumstances stipulated in criminal law,to determine subjectively"knowledge"and to determine whether the objective incrimination standard has been reached objectively,the principle of subjective and objective consistency should be combined.The identification of the"indecency in public in a public place"circumstances must be understood in a variety of ways.It is particularly important to strive to construct a diversified protection system with prevention and punishment at the core.
