摘要
指定管辖作为监察管辖的重要组成部分,是监察机关上下联动进而形成监察一体化的有效依托,对于防范权力干扰、排除人情障碍、克服舆情负面影响、平衡办案资源有着非常重要的实践价值。然而,由于指定管辖自身的不确定性、独立性以及行政强制性等特征,在适用中容易产生随意化倾向、程序衔接障碍以及权利救济渠道不畅的弊端。在监察一体化模式下,需要明辨主次、内外协调、多管齐下,厘定指定管辖的适用原则,规范指定管辖的程序,适当拓展当事人权利救济渠道,以促使指定管辖在监察一体化中发挥出更大效能,推动国家治理体系和治理能力现代化。
As an important part of supervision jurisdiction,designated jurisdiction is an effective foundation for the formation of a unified supervision mechanism by means of coordinated efforts of different levels of supervising organs,and is of considerable practical value for preventing the interference of authorities in power,of social relationship,for overcoming negative influences of public opinions and for balancing resources for case investigation.However,qualities of uncertainty,independence and administrative compulsiveness of designated jurisdiction are likely to result in such deficiencies as arbitrariness,difficulties in procedural connection and retardation in interest protection.In the supervision integration mode,applicable principles for designated jurisdiction have to be decided,priorities to be set,internal and external affairs to be coordinated,multiple efforts to be made so that designation procedures can be confirmed,right protection of related individuals to be expanded appropriately to have designated jurisdiction play a more important role in the integration of supervision and inspection.Modernization of national administration system and capabilities is to be facilitated in the process.
