摘要
海洋命运共同体与人类命运共同体在内涵上一脉相承,蕴含共建、共商、共享、共担、共赢的价值理念。通过分析《罗得海法》所确立的共同海损与海难救助制度,14世纪形成于意大利的海上保险制度以及近代建立的船舶污染损害赔偿等海商法律制度,认为其价值观彰显和体现海洋命运共同体的价值理念,也是海洋命运共同体价值观在海商法领域的具体体现和应用。适逢《中华人民共和国海商法》修订,深刻领会和汲取海洋命运共同体理念的价值内涵,将为中国海法体系的完善提供强有力的理论支撑,并助力海洋强国建设。
The community of ocean destiny and the community of human destiny have the same connotation,which highlight the profound connotation of joint construction,joint consultation,joint sharing,joint commitment and a win-win situation.By reviewing general average and salvage at sea formed in Rhodian Sea-law,marine insurance established in Italy in the fourteenth century,and compensation for marine pollution from ships constructed since modern times,it is believed that all these contain the core nature and the value of the community of ocean destiny and are the specific embodiment and application of the values of the community of marine destiny in maritime law system.The revision work of the Maritime Code of the People’s Republic of China is in the progress now.It is significant to deeply understand and draw on the connotation of the concept of the community of ocean destiny,which will provide a strong theoretical support for the improvement of China’s sea law system as well as building China into a maritime power.
