摘要
空域是航空活动的主要场域,因为历史、政治以及经济等原因,我国现行对空域的使用主要采取由政府完全主导的行政分配制度。在该制度安排下,我国空域使用面临着效率低下、分配不公等弊端,极大影响着空域使用者的积极性。将空域使用权纳入物权化领域进行调整成为缓解这一困境的有利途径。空域资源使用权应当是一项准用益物权,其具备用益物权的一般特征,然而在权利取得方式、母权生成等方面并不同于一般用益物权,将空域使用权定为准用益物权更为妥当。
Airspace is the main field of aviation activities.Due to historical,political,and economic reasons,China's current use of airspace mainly adopts an administrative distribution system that is completely dominated by the government.Under the arrangement of this system,the use of airspace in China is faced with the disadvantages of inefficiency and unfair distribution,which greatly affects the enthusiasm of airspace users.The adjustment of airspace use rights into the real rights becomes a favorable way to alleviate this predicament.The right to the use of airspace resources should be a quasi-usufruct right,which has the general characteristics of the quasi-usufruct right.However,it is different from the general usufruct right in terms of the right acquisition method and the generation of the mother's right.It is more appropriate to define the right to the use of airspace as a quasi-usufruct right.
