村民自治视域下的乡村德治论纲被引量：30

摘要乡村振兴要植根于中国乡村的社会和文化土壤之中,植根于乡村土地上努力生活的具体的人,植根于多样性的乡村特色和集体记忆之中。立足乡村发展和村民的现实需要,回溯传统社会的德治传统,激活并超越性借鉴中国古代思想精华,乡村德治才能真正为盘活村民自治提供契机和动力。在新的历史条件下,伴随民族国家的建设进程和乡村治理体系的推进,乡村德治主体趋向多元化,并依据法理化的民间规范和礼俗化的国家价值观重构起多维协同共治的权威、话语体系。其中,村规民约中的柔性线条和家风家法的核心内容充分彰显现代德治的新特质,乡贤治村和人民调解中日益凸显的德治功能成为村民自治视域下规范村民行为、化解社会冲突的合理依据。 Rural revitalization should be rooted in the social and cultural soil of rural China, among the specific people who strive to live on the rural land, and in the diversity of rural characteristics and collective memory. Only based on rural development and the realistic needs of villagers, tracing the tradition of moral governance in the ancient world, activating and transcendent the essence of ancient Chinese thoughts, can the rural rule of virtue truly provide an opportunity and power for the revitalization of villagers’ self-Governance. Under the new historical conditions, along with construction of the nation-state and the advancement of rural governance system, the mainstay of rule of virtue tends to be diversified. They reconstruct the authority and discourse system of multi-dimensional co-governance by relying on the folk norms of jurisprudence and the national values of etiquette and custom. The flexible lines in village rules and regulations and the core content of family custom and family law fully demonstrate the new characteristics of modern rule of virtue. Ruling villages by virtue and the folk’s mediation can regulate villagers’ behavior and resolve social conflicts.
